The following terms of use ("Terms of Use") govern your use of certain NASCO websites (the "Sites" or "Site" and including, "NASCO Central" and "Nshare"), and by accessing, viewing, uploading or using any of the Sites or any of the Content (as the term is defined below) on a Site, you acknowledge that you understand and agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, you are not authorized to use the Site and must exit the Site immediately.

Protected Access Site. The Sites and all the information, material and contents ("Content") on the Sites are intended for use only by those individuals, persons or entities authorized by NASCO to access and use the Sites. Plan users are only authorized to access the Sites using secured means as authorized by NASCO and are required to use their Plan email address as their authorized user ID. Any other access to the Sites will be as determined by NASCO.

All passwords and other user ID information used to access the Sites must be kept confidential. Under no circumstances should you share your password or provide access to the Sites to an unauthorized individual, person or entity. If you have reason to believe that your password has become known to or used by another individual, you must immediately contact ncsc@nasco.com to report the issue and log in to change your password.

Termination of Access. NASCO reserves the right in its sole discretion to immediately terminate any user's access at any time.

Appropriate Use. You may not use the Sites to upload or send: (a) offensive, obscene or disruptive material, including but not limited to material that promotes, fosters, or perpetuates discrimination on the basis of race, creed, color, age, religion, gender, marital status, status with regard to public assistance, national origin, physical or mental disability, or sexual orientation, (b) promotion of an illegal activity, (c) promotion of a political candidate, (d) promotion of commercial services or products other than significant sponsors, affiliations, or business partnerships, (e) viruses, or other material that may disrupt or interfere with hardware or software functionality, or (f) spam. Notwithstanding the foregoing, NASCO is not responsible and shall not be liable for any Content posted to or sent from the Sites by users of a NASCO Site, whether by e-mail, or by any other means. Opinions or comments contained in such Content reflect the views of the author and not of NASCO, unless NASCO expressly states to the contrary.

Contributions to the Sites. All contributions and content on the Site are subject to review and audit by NASCO at any time. Users uploading content to a Site will be required to identify the classification of the content of the document.

By transmitting or uploading any Content to NASCO, you automatically grant NASCO a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, redistribute, transmit, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any rights that may exist in such Content. Further, NASCO is free to use any ideas, concepts, know-how, techniques, and suggestions contained in any Content or communications you send or post to the Site for any purpose whatever.

Proprietary Rights. All Content on the Sites is protected by law, including without limitation, United States copyright law. NASCO owns a copyright in the Sites as a collective work and/or compilation, and in the selection, coordination, arrangement, organization and enhancement of the Content. All trademarks, service marks or other logos featured on the Sites are protected by applicable law. Any use or misuse of these trademarks, service mark or logos is expressly prohibited, and may violate applicable federal and state law.

Removal of Content; Corrections and Changes. NASCO may add, modify or remove any Content from the Sites at any time without notice, and NASCO makes no commitment to update the Content contained herein. While NASCO endeavors to keep the Content on the Sites up to date, NASCO cannot assume responsibility for any errors or omissions in the Content. NASCO further does not warrant the accuracy or completeness of the Content.

Links to Third Party Web Sites. The Sites may contain links to third party web sites, extranet sites, or sites on other networks for the convenience of users in locating information and services that may be of interest ("Third Party Sites"). Users of the Sites acknowledge that Third Party Sites are third-party sites maintained by persons or organizations independent from, and over which, NASCO exercises no control. NASCO expressly disclaims any and all responsibility for the content and quality of products or services provided by or advertised on or through Third Party Sites. NASCO does not control, endorse, promote, or have any affiliation with any Third Party Site, unless otherwise expressly stated to the contrary on the Site.

Use of the Sites. Use of the Sites is at your own risk and is subject to all applicable state, federal and international laws and regulations. NASCO is not liable for any loss from a matter resulting from, but not limited to, failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes, natural disasters, strikes or other labor problems, wars, or governmental restrictions.

No Legal Advice. Nothing contained, expressed, or implied in the Sites is intended as, nor shall be construed or understood as, legal advice, guidance, or interpretation. No attorney-client relationship is established between NASCO and you by reason of your use of a Site or under any circumstances whatever. If you have questions about any law, statute, regulation, or requirement expressly or implicitly referenced in the Sites, you should contact your own legal counsel.

Disclaimer of Warranty and Liability. YOU EXPRESSLY UNDERSTAND AND AGREE THAT: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NASCO EXPRESSLY DISCLAIMS ANY WARRANTIES CONCERNING THE ACCURACY, SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE SITES. NASCO DISCLAIMS ANY RESPONSIBILITY FOR THE DELETION, FAILURE TO STORE, MISDELIVERY, OR UNTIMELY DELIVERY OF THE CONTENT, OR FOR ANY HARM RESULTING FROM DOWNLOADING OR ACCESSING ANY CONTENT THROUGH THE SITES, INCLUDING, WITHOUT LIMITATION, HARM CAUSED BY VIRUSES OR SIMILAR CONTAMINATING OR DESTRUCTIVE FEATURES. PRIVACY STATEMENT


NASCO has created this privacy statement in order to demonstrate our commitment to privacy. The purpose of the Sites is to disseminate important information about NASCO as well as provide updates, and general information that may be of value to you, the customer, and to provide NASCO customers with access to digital workspaces. Generally, NASCO only collects identifiable information that is specifically and voluntarily provided by a visitor to the Sites. When a visitor provides this type of identifiable information to us, we use it for the purposes for which it was provided. Our policy is not to share personally identifiable information with third parties, unless required by law, or unless explicitly requested by a visitor. We recognize that your information is valuable and we take all reasonable measures to protect your information while it is in our care. NASCO operates using the following privacy principles:

  • The only information NASCO obtains about you is supplied voluntarily by you at the time of your registration to use the Site(s).
  • Information that could be used to identify or contact you, such as name, e-mail address or other personally identifiable information will not be disclosed to parties outside of NASCO or if you are a Plan customer resource, your Plan.
  • The information provided on the Sites is provided for reference only and constitutes no legal, financial or other professional advice. The information on the Sites is subject to change. The information on the Sites is believed to be accurate, and while steps have been taken by NASCO to ensure the accuracy of the information, no express guarantee is made as to the accuracy of the information. NASCO Solution


NASCO (and its third party contractors) developed and NASCO owns and/or licenses a proprietary group of software, systems and products known as the "NASCO Solution", which consists of (i) the software as provided by NASCO (some of which may be third party software applications) to NASCO's customer and clients, including the "NASCO Processing System" or "NPS" and (ii) NASCO products provided by NASCO and/or received by NASCO's customers and clients. NASCO shall at all times own all Intellectual Property Rights recognized in any country or jurisdiction worldwide relating to the NASCO Solution and to any modification, extension, or derivative work of the NASCO Solution.

Information Collection and Use


Any personally identifiable information you give us will be used only to provide you with access to the Site(s), to provide the service or information you have willingly requested or for which you registered or to communicate with you. NASCO will not collect any other personally identifiable information from you unless you voluntarily provide it to us through e-mail or otherwise.

We gather and analyze data regarding usage, such as site/page hits and data classification usage to monitor and evaluate site usage as well as monitor that Restricted Data is appropriately restricted.

Registration Process


If the Sites require Customer Plan visitors to register, then registration will include the collection of contact information such as username and e-mail address. All requests for access to the Sites are submitted to NASCO for appropriate review and approval.

Cookies


What is a cookie?

A cookie is a piece of information that is sent to your browser along with a web page when you sign-on to a website. It is a unique identifier that a web server places on your computer. There are two main types of cookies applicable, (1) session cookies and (2) persistent cookies.

A session cookie is a text string (line of text) that is stored in computer memory temporarily. Session cookies are used to enable a web site to track the pages you visit during a session so that information can be customized for you. Once you exit the website, the session cookie is destroyed. Session cookies are utilized on the Sites.

Persistent cookies are small files used by a web server to deliver data to a Web client (user); request that the client store the information; and in certain circumstances, return the information to the web site. Web sites can thus "remember" user information, for example their preferences for a particular web site, and allow the use of user passwords. The web site may deliver one or more cookies to the client. The client stores cookie data in one or more files on its local hard drive. In most cases the user can control a client browser to allow the use of cookies or disallow its use. Persistent cookies are not utilized on the Sites.

Sharing


NASCO will not sell, share, or rent your provided information to others in ways different from what is disclosed in this statement. Any personally identifiable information you give us will be used only to provide the information you have requested, (e.g. a request to view project information) or for which you registered. Your personally identifiable information, including your e-mail address, will not be sold, rented, licensed, or otherwise shared with third parties. The non-personally identifiable information we gather in aggregate form may be used to improve the Sites.
